The doctoring profession is one that is highly lauded in Singapore, and that’s especially so during these tumultuous times – when a pandemic has arrested the entire world and caused mankind to be in general health risk and distress.

Truly, they have never been more angelic in nature and in importance.

However, it should be noted that even so, there are doctors out there who are anything but angelic, as they abuse their patients’ trust to satisfy their basic human needs. These so-called professionals are who we deem black sheep in the otherwise respected industry, and leave a taint on a trade that has been serving the public for ages.

So as you may have surmised, any decent doctor would want to avoid such affiliations.

A notion that Dr Lui Weng Sun must have feared when a Vietnamese patient filed a police report against him.

A 48-year-old doctor has been acquitted of a molestation charge, after the judge found the supposed victim’s testimony to be inconsistent, unconvincing and generally a tad bit fishy.

The woman’s evidence, in particular, was deemed to be “unconvincing”, and her boyfriend’s behaviour was stated to be “highly unusual”.

Numerous inconsistencies were also reported.

Lest you’re unaware, the molestation case was alleged to have occurred on 6 November 2017, at Northeast Medical Group clinic in Block 39 Jalan Tiga.

During the consultation session, the purported victim, a Vietnamese National, allegedly had her bra cup unceremoniously pulled down by the doctor – who then situated a stethoscope on her chest and molested her.

Apparently, Dr Lui had intended to “check the things inside”.

No, not silicone.. probably. Perhaps just the liver, heart and… you know, the usual works.

Anyways, a police report was subsequently lodged.

In response, the doctor claimed that the allegations were “outrageous” and “ridiculous” in nature, and stated that he “definitely did not do it” and that he would “never molest patients”.

He also stated that the woman’s boyfriend had called him after the incident and said: “I don’t know about you doctors, you have money and lawyers, and (I’m) also afraid of threatening you.”

“To me, this is a small matter, but to you, it’s a very big matter.”

“Confusing And Contradictory”

According to Judge Jasvender Kaur, the woman’s evidence was deemed to be “confusing and contradictory” in several areas.

For instance, the woman expressed in police statements that Dr Lui had lifted her shirt once. In court, however, she stated that he had done so two times instead.

“I fail to see why she could not give a consistent version in the police statement,” said the judge.

Similarly, the alleged victim was not consistent with her accounts of a clinic assistant’s knock on the door and even changed her evidence when asked whether Dr Lui had indeed used his stethoscope after the assistant had vacated the room.

The issue of the woman’s bra cup was also a vital factor in the judge’s decision-making process. In court, the woman stated that her bra cup had been turned outwards. In her police statement, however, she expressed that her bra had been pulled down instead.

“If only one bra cup was turned upwards to expose her breast, the complainant could have done this to show (the officer). There’s no explanation why she described it with an inconsistent gesture,” said the judge.

As for the woman’s boyfriend, he was said to have displayed “highly unusual” behaviour in regards to the incident.

“He said this matter ‘affects you greatly but does not matter to us’,” said Judge Kaur. “(He said) ‘you should know very well this matter affects you doctors greatly’. He knew the stakes were high for the accused.”

“I find his conduct to want to engage with the accused after the first call highly unusual,” she said.

With all the points in mind, the judge ultimately ruled in favour of the accused doctor, and acquitted him of the molestation charge.

Cases

Though it may appear to be a case of false allegations in Dr Lui’s case, it should be noted that instances where doctors have crossed the line with their patients are, though rare, very much existent.

Between May 2009 and June 2013, a general practitioner in east London was said to have committed a string of sexual offences against numerous female patients.

The youngest victim was just 11.

And on 25 January 2021, a former VA doctor was given a prison term of 25 years for sexual offences against three patients.

“In a despicable betrayal of his oath, he used his specialized medical knowledge and expertise to sexually abuse his own patients,” said Deputy Assistant Attorney General Gregory Friel of the Civil Rights Division,

“It is a testament to the bravery of our veterans that so many came forward to bring this defendant to justice.”
