What Will Happen to the Drivers?

Are drivers always punished for fatal traffic accidents? Not exactly.

They can be charged if their actions fall under one of these criteria:

  • Caused death by reckless or dangerous driving, or
  • Cased death by rash or negligent act.

There are still specific considerations for reckless or dangerous driving, such as running red lights or exceeding speed limits. This includes the road’s condition or nature and the traffic on the road at the time of the incident.

If convicted of reckless or dangerous driving, the drivers could be imprisoned for two to eight years and disqualified from driving for ten years.

Rash or negligent acts are not exercising caution (conscious or unconscious of the consequences), such as not checking for pedestrians or vehicles coming from opposite directions.

If found guilty, the drivers may be imprisoned for up to five years or a fine, with the possibility of getting their licence revoked.
