A 44-year-old palm oil worker was sentenced to 124 years in jail and 92 strokes of the cane at the Muar Sessions Court on 26 Jun 2025.
The father pleaded guilty to all 14 charges of sexually abusing his two daughters over an 11-year period.
Judge Sayani Mohd Nor delivered the sentence after the accused admitted to charges of molest, rape and sodomy against his biological daughters.
The victims, now 16 and 17, were abused from the ages of five and six, respectively.
Sexual Abuse Charges Against Younger Daughter
The accused was sentenced to 21 years in jail and six strokes of the cane for the first three charges.
These involved physical sexual abuse against his younger daughter, now 16, at their home in Batu Pahat between 2014 and 2022.
The abuse began when the victim was five years old and occurred during both day and night. He faced prosecution under Section 14 (a) and (d) of the Sexual Offences Against Children Act (Socca) 2017 for these charges.
Multiple Locations Used for Abuse of Elder Daughter
The fourth to 14th charges related to rape, sodomy and physical sexual assault against his eldest daughter, now 17. The abuse took place at various locations including a hut in an oil palm plantation and a store between 2014 and May 2025.
These charges fell under Section 376(3) of the Penal Code, Section 14(d), and Section 377C of the same code. The total sentence for these 11 charges amounted to an imprisonment term of 103 years and 86 strokes of the cane.
The court ordered sentences under Section 376(3) and Sections 14(a) and 14(d) to run concurrently. The additional sentence under Section 16 would begin after completion of the first term.
Due to Section 288 of the Criminal Procedure Code limiting maximum punishment, the accused will serve 22 years in prison and receive 24 strokes.
Victims’ Declining School Performance Led to Discovery
A police report was filed after the victims’ mother, who is also the defendant’s wife, received a call from their school regarding both children’s declining academic performance.
The daughters subsequently told their teacher and mother about the sexual abuse they had suffered since the ages of five and six.
One victim almost fainted and experienced difficulty breathing after being raped. Despite pleading multiple times for the abuse to stop, the man ignored her pleas.
The victim also experienced bleeding and was threatened not to tell anyone — including her mother — or she would be harmed.
Deputy public prosecutor Othman Affan Ismail handled the prosecution. The accused appeared in court without legal representation.
The court ordered the accused to undergo two years of police supervision upon completion of his sentence, in accordance with Section 27 of the Sexual Offences Against Children Act 2017.
