On Wednesday (7 February), the United States President Donald Trump signed an executive order to ban transgender girls and women from female sports. No prizes for guessing what the order is called — it’s called “Keeping Men Out of Women’s Sports”.

At this point, you’ve probably heard plenty on the debate about whether transgender girls and women should be banned from female sports. In US President Trump’s eyes, they should.

According to the executive order, allowing transgender women to compete in female sports are the equivalent of allowing men to compete in female sports. And yes, that’s literally what the order states: “In recent years, many educational institutions and athletic associations have allowed men to compete in women’s sports.”

The executive order further adds that allowing transgender women to compete in female sports is demeaning, unfair, dangerous to women and girls, and denies women and girls the equal opportunity to take part in and excel in competitive sports.

If you didn’t already know, an executive order is essentially a written directive signed by the president, ordering the government to take certain steps to ensure laws are faithfully executed. In Trump’s executive order to ban transgender women from female sports, the laws to be “faithfully executed” is mainly the US’s Education Amendments Act of 1972.

The portion of the Education Amendments Act referred to by the executive order is Title IX, which provides that educational institutions receiving federal funds cannot deny women an equal opportunity to participate in sports.

You can see how the debate arises here. Some would say that transgender women are also considered women, who should not be denied an equal opportunity to participate in sports. Others, such as Trump, take the position that when transgender women are allowed to participate in sports, women who are biologically female are denied an equal opportunity to participate in sports.

Effect of the Executive Order

So, how does Trump’s executive order seek to ban transgender women from participating in female sports?

For one, the order directs the US Department of Justice to ensure all government agencies enforce a ban on transgender women and girls from taking part in female school sports. It  threatens to cut off federal funding for schools which allow transgender women and girls to compete in female sports competitions.

The National Collegiate Athletic Association (NCAA), the governing body for collegiate sports in the US, has since conformed with the executive order. It has banned transgender women from competing in female sports effective immediately.

Previously, the NCAA allowed transgender women to compete in female sports so long as they met the relevant sport’s testosterone limits.

But collegiate sports are far from the only area affected by the order. The executive order also seeks to pressure the International Olympic Committee (IOC) to ban transgender athletes.

Yes, you read that right. Currently, the IOC allows transgender athletes to compete under general guidance preventing any athlete from gaining an unfair advantage. Trump is seeking to change that.

Further, the executive order will also direct the Department of Homeland Security to review applications of transgender women seeking to enter the US to compete in female sports, to ensure they align with their sex assigned at birth.

The 2028 Summer Olympics are due to be held in Los Angeles.
