Andrew Tate and his brother Tristan Tate have been arrested in Miami as the United Kingdom seeks to extradite them over allegations including rape, human trafficking and assault. The brothers were taken into custody by the US Marshals Service on Saturday, 18 July 2026. The agency told the Associated Press that they were arrested on a sealed warrant. They are being held in federal detention and are scheduled to appear before a federal magistrate in Miami on Monday. Both men deny wrongdoing. Their arrest is part of the extradition process and does not amount to a finding of guilt. British Prosecutors Announced 38 Further Charges The arrests came as the UK’s Crown Prosecution Service, or CPS, announced that it had decided to prosecute the brothers over 38 additional offences involving four further alleged victims. Andrew Tate, 39, faces 32 of the new charges. They include seven further counts of rape, three counts of arranging or facilitating trafficking for sexual exploitation, three counts of assault occasioning actual bodily harm, and 19 charges relating to indecent images of a child and extreme pornography. Actual bodily harm is a category of assault under English law in which the harm caused must be more than temporary or insignificant. Tristan Tate, 38, faces six further charges. These comprise two counts of rape, one count of sexual assault and three counts of arranging or facilitating trafficking for sexual exploitation. The alleged offences took place between July 2010 and August 2017, according to the CPS. Prosecutors said the decision followed the receipt of another evidence file from Bedfordshire Police. The Brothers Now Face 59 UK Charges in Total The new cases are in addition to 21 charges announced against the brothers in 2025. Andrew had already been charged with three counts of rape, four counts of actual bodily harm, two counts of human trafficking and one count of controlling prostitution for gain. Tristan had already been charged with three counts of rape, six counts of actual bodily harm and two counts of human trafficking. The previous charges involved three alleged victims. Together with the four additional alleged victims linked to the latest charges, the UK proceedings now involve seven alleged victims. Across the old and new cases, Andrew faces 42 charges while Tristan faces 17, bringing their combined total to 59. What Happens During the Extradition Process The Miami arrest does not mean that the brothers will immediately be sent to the UK. A US court must first decide whether Britain’s extradition request meets the requirements of American law and the extradition treaty between the two countries. This hearing is not a criminal trial deciding whether the allegations are true. It determines whether the legal conditions for surrendering the brothers to British authorities have been met. Should a judge certify that they can be extradited, the case will enter its executive phase. The US Secretary of State would then decide whether to authorise their surrender to the UK. The Associated Press reported that a US district judge is expected to consider the extradition conditions in the coming weeks. The Brothers Deny the Allegations Joseph McBride, a US lawyer representing the brothers, described the latest allegations as “filth and slander”. He claimed that the charges were intended to interfere with defamation lawsuits filed by the brothers in the US and said he believed the extradition request would ultimately be rejected. The Tate brothers have repeatedly denied allegations of sexual abuse and human trafficking made against them in Britain and Romania. The CPS has also cautioned that the criminal proceedings are active and that the brothers have the right to a fair trial. They Are Still Being Investigated in Romania The British proceedings are separate from the Tate brothers’ legal cases in Romania, where they moved in 2016. Romanian authorities first detained them in December 2022 during an investigation into allegations including human trafficking. They were initially held in custody before being moved to house arrest and later placed under judicial controls. A Romanian court declined to send the first case to trial in 2024 and returned it to prosecutors after ruling that some evidence was inadmissible. Prosecutors continued investigating that case and opened a second investigation involving further allegations. On 6 April 2026, a Romanian court lifted the remaining judicial control measures against the brothers. However, the criminal investigations were not closed. Their arrest in Miami has now placed the immediate focus on whether they will be extradited to Britain to face the 59 UK charges.
